Welcome to Tuton. These Terms of Service ("Terms") govern your access to and use of the Tuton platform, including our website, applications, and services (collectively, the "Service"). By using Tuton, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Tuton is a platform designed for freelance English tutors to manage their tutoring business. The Service includes:

  • Student management and progress tracking
  • Lesson scheduling and calendar integration
  • Video conferencing for online lessons
  • Vocabulary and learning material management
  • Messaging and communication tools
  • Payment and package management

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access.

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Upload malicious code or interfere with the Service's operation
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to spam or send unsolicited communications
  • Scrape, crawl, or use automated means to access the Service without permission

5. Content and Data

5.1 Your Content

You retain ownership of content you create or upload to Tuton, including student information, lesson notes, and materials. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

5.2 Student Data Responsibility

As a tutor, you are responsible for ensuring you have appropriate consent to input and process student information through Tuton. You must comply with applicable data protection laws regarding your students' personal information.

5.3 Prohibited Content

You may not upload content that is illegal, infringes on intellectual property rights, contains malware, or violates any third party's rights.

6. Subscriptions and Payments

6.1 Subscription Plans

Access to certain features requires a paid subscription. Subscription details, including pricing and features, are available on our pricing page.

6.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe.

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial periods.

6.4 Price Changes

We may change subscription prices with 30 days' notice. Price changes do not affect current billing periods.

7. Third-Party Integrations

The Service may integrate with third-party services (e.g., Google Calendar, Stripe). Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for third-party services.

8. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Tuton and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUTON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless Tuton and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may terminate your account at any time through your account settings or by contacting support.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tuton operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If resolution is not reached within 30 days, disputes shall be resolved through binding arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
